Minute Book 3: 1726-September pt.1: Governor Burnet Holds a Conference and Obtains a Questionable Deed

1726-9-7In preparation for the conference held September 7-14, Governor William Burnet issued a proclamation that prohibited giving liquor to Indians  or trading in Indian goods to be used as presents, thus maintaining control over goods that might influence native decision makers. The proceedings printed in Documents Relative to the Colonial History of the State of New York, Volume 5, beginning on page 786, are substantially the same as the version in the records of the Indian Commissioners. I have not transcribed them, but they are summarized below. DRCHNY also includes a letter that Governor Burnet sent to the Lords of Trade (p. 783 et seq.) along with the treaty, in which he explains that his main goal was to prevent the Six Nations from authorizing the French fort at Niagara. He added some related correspondence between himself and the Governor of Montreal and a questionable deed to Seneca, Cayuga, and Onondaga lands (DRCHNY 5:800) negotiated secretly with a small group of sachims at the end of the conference. The deed is not part of the records of the Indian Commissioners.

On September 7th Governor Burnet held a private meeting with his staff and a small group of two sachems from each of the Six Nations. Part of the record of this meeting is written out as a series of queries and answers, a different format from the usual one in which wampum belts were presented on specific points and the other side would consider them before responding to them as a group. Burnet, or whoever wrote up the minutes of the meeting, may have structured it this way in order to create a record that supported the idea that the Six Nations were subject to British dominion and the governor could query them as he would do with a subordinate official.

At the private meeting, the Onondaga speaker Ajewachta recounted how the French envoy “Monsieur Longueuil” (Charles Le Moyne de Longueuil, 1687-1755) had presented the building at Niagara as a trading house to replace an existing bark house that had fallen into disrepair. According to Ajewachta, the Onondagas agreed to it despite objections from the Senecas who actually owned the land. Ajewachta tried to reassure Governor Burnet that the region encompassing Niagara and Lake Ontario, would remain “a path of peace for all christians and Indians to come and go forward and backward on account of Trade.” He said the Six Nations told the French that they held firm to the alliance with the English as well as to peace with the French.  They wanted the French and the English to settle any disagreements “at Sea and not in [the Six Nations’] Country.”

When Governor Burnet asked the sachims whether they were not sorry that they had agreed to the new building at Niagara, they said Longueil had won them over but they immediately regretted it. They described the extensive negotiations between them and the French in which the Onondagas had tentatively agreed to the French request., but subject to the approval of the rest of the Six Nations and void if they disallowed it. A Seneca Sachim named Kanakarichton verified that the land at Niagara belonged to the Senecas along with land on the other side of the lake. Nonetheless, the French who came to build the fort insisted on finishing it even while the Six Nations were still discussing the situation with the French governor through the interpreter Jean Coeur (Louis-Thomas Chabert de Joncaire). When the building was finished it would be staffed by 30 soldiers as well as officers and a priest.

The Six Nations also said they had heard that two Frenchmen had asked an unidentified nation living on the Ohio River to take up the hatchet against the Six Nations on behalf of the French, but that nation had refused. The Frenchmen told them that papers were going to circulate to Philadelphia, New York, Albany, and Montreal about an agreement between the French and the English to cut off their nation once the fort at Niagara was complete, but the warriors burned the papers, preventing it. They also heard ominous things from Canada about proceedings between the French and the English, and asked Governor Burnet what news he had heard. Finally they said the traders in their country were cheating them by selling water disguised as rum that went bad in a day or two.

Governor Burnet promised to send someone to oversee the trade to prevent cheating. He explained that France and Great Britain were currently allies who were going to war with Spain.  He read them the text of a letter that he had sent to the governor of Canada about the Treaty of Utrecht, which required the French in Canada not to hinder or molest the five Nations or their allies and guaranteed free trade for all. After Governor Burnet encouraged them to do so, the 12 sachims asked him to contact King George and request him to write the King of France to object to Fort Niagara. Burnet closed the meeting by stating that what had transpired would now be stated publicly.

Two days later proceedings resumed with a full gathering of all the representatives of the Six Nations, Governor Burnet, the Commissioners for Indian Affairs, and aldermen from the City of Albany. Governor Burnet, who had been studying the French works on the subject, reviewed in detail the history of the wars between France, its native allies, and the Six Nations, as well as their peaceful relations with the English. He told them that the King of Great Britain was their “true father” who had always fed and cloathed them and provided them with arms.  He renewed the Covenant Chain and gave them a belt of wampum.

Governor Burnet told the gathering that Monsieur Longueuil (Charles Le Moyne de Longueuil, 1656-1729, Governor of Montreal, whose son of the same name was in charge of Fort Niagara) had sent him a letter claiming that the Six Nations had unanimously agreed to the new fort at Niagara, but the Six Nations now said they were afraid the fort would enable the French to keep them from their hunting grounds and prevent the far nations from coming to trade.  He explained the free trade provisions of the Treaty of Utrecht and said he would convey the Six Nations’ complaints about Fort Niagara to King George, who would ask the King of France to review whether it violated the Treaty of Utrecht. If the fort was in violation it should be removed.

Governor Burnet also said that when he conveyed a request from the Six Nations to the governor of Virginia to set up a meeting, Virginia and South Carolina had complained about attacks on their frontiers by Tuscaroras and others. Burnet asked that the offenders be punished. In particular the Senecas attacked an English trading house called Constichrohare at Characks (Cheraw) and captured an Indian boy who was the slave of Nathaniel Ford along with guns, blankets and powder.  The goods and the Indian slave should be delivered to Peter Barbarie, who would reimburse the captors in the name of the owner.  Burnet asked the Six Nations not to allow “French Indians” to pass through their country in order to attack the southern colonies.

Kanakarighton responded for the Six Nations. After renewing the Covenant Chain, he said that the Six Nations had already asked the Governor of Canada to stop building the fort at Niagara.  They now came to the English “howling” because the French were building on their land. He presented a belt to the governor and asked him to write to King George as soon as possible to have the fort removed.

Kanakarighton notified Governor Burnet that Jean Coeur was expected soon at Onondaga, where he would probably spread negative rumors about the English. He asked Burnet to send a “Man of Experience” to Onondaga to hold a meeting with Jean Coeur in front of the Six Nations. It should be conducted  speaking “nothing but Indian between the brother Corlaer and the French, every one to answer for himself concerning what ill Reports he shall have spread” in order to get to the truth and “know who is the lyar.”

Kanakarighton acknowledged Burnet’s concerns about frontier attacks on Virginia and South Carolina. He said that Senecas, Mohawks, Tuscaroras, and “French Indians” were all involved, but their intention was only to pursue Indian enemies present in the trading house that was attacked. The slave that Governor Burnet wanted returned had been given to “Indians who live on a Branch of Susquehannah River, which is called Soghniejadie.” He suggested that the English look for him there themselves because the place was “nearer to you than us” (probably meaning nearer to Virginia.) He asked that the attacks be forgiven as merely accidents committed without the approval of the sachems and agreed to try to stop French Indians to travel through Iroquoia to go fighting.  He pointed out that the English must do their part “for many go fighting thro’ Albany to the English Settlements, who do not come thro’ the Six Nations.

Kanakarighton concluded by adding to what Burnet had said about the history of relations between the Six Nations and the English. They arose through trade at a time when goods were cheap, but now goods had become expensive. He asked for cheaper prices, especially for powder.  Moreover, now that the Six Nations had agreed to let the English trade (“place Beaver Traps”) on the Onondaga River, they had been deceived, since traders there sold river water as rum for a high price. But instead of asking for better rum, he asked for no rum, since it was causing quarrels between married couples and between young Indians and sachims. When Indians from beyond Iroquoia wanted rum, they should come to Albany for it as they used to do, while traders to the Six Nations should bring powder and Indian goods for the same price as they would cost at Albany.

Finally he conveyed a request from the Senecas that Myndert Wemp return to their country as a smith along with an armorer, Andries Nak, who should be taught to speak their language.

Governor Burnet agreed to ask King George to persuade the King of France to remove Fort Niagara.  He did not agree to send a representative to Onondaga for a meeting with Joncaire, claiming that the Six Nations’ own experience should be enough to show that French reports about the English were false. However, he said he would send someone to the Senecas for the winter to address their concerns. He said he would tell the governor of Virginia what the Six Nations asked (that frontier incidents be forgiven) but the best way to prevent Virginia from taking up the hatchet was to stop such attacks. Burnet said he could not control what merchants charged for their goods, and refused to stop selling rum on the Onondaga River.  However, he would post someone there to oversee the trade and prevent cheating, and would ask Myndert Wemp to return to the Seneca country as a smith along with an armorer. He wished them a good journey home, told them he was providing them with a “noble Present” from the king, and explained that rum and provisions would be given to them for their journey after they were “past Schenectady.”

Burnet also held a brief conference with the River (Mohican) and Schaghticoke Indians the same day, condoling two sachims who had died, and recommending Wawiachech to replace them, renewing the Covenant Chain, and admonishing them to stay at Schaghticoke and not go to Canada.  They thanked him and explained that the people who left for Canada were fleeing debts, but those who remained would live and die at Schaghticoke.

On September 14th Burnet held another private conference, this time with two sachims each from the Senecas and Onondagas and three from the Cayugas, but no Oneidas, Tuscaroras, or Mohawks. The names of those who attended are given as Kanakarighton, Thanintsoronwee, Ottsochkooree, DeKanisoree, Aenjeweerat, Kackjakadorodon, and Sadekeenaghtie. Going considerably beyond what had been discussed in the full conference, the small group consented to Governor Burnet’s suggestion that they sign what Burnet called a “deed of surrender” putting their land in trust to the King of England to be protected for the use of their nations.

A deed was signed, becoming part of the “Original Roll in the Secretary of State’s Office” in Albany and later printed in DRCHNY 5:800. No copy was kept in the records of the Commissioners of Indian Affairs, which generally did not include deeds. Peter Wraxall was not aware of the deed when he wrote his Abridgement, which discusses the September 1726 conference on p. 168-169.

In his letter to the Lords of Trade sent with the treaty, (DRCHNY 5:783-785) Governor Burnet explained that he did not tell the Mohawks or Oneidas about the September 14th meeting, since their lands were not at issue and if he told them the French might learn about it sooner. Burnet told the Lords of Trade that he pursuaded the New York Assembly to agree to his proposal to build an English fort at the mouth of the Onondaga River (Oswego). Once it was built he intended to meet the Indians again and get them to publicly confirm the deed, which “some of them have signed.” Thus he acknowledged that it required further confirmation.  The deed surrenders the land to be “protected & Defended” by the king for the use of the three nations. It says nothing about building forts. At Burnet’s conference with the Six Nations in 1724, he had succeeded in getting them to agree reluctantly to a trading house at Oswego, but not to a fort.

Minute Book 3: 1725-April

The Six Nations Don’t Want a French-English War in Iroquoia

On April 11th, a delegation from Onondaga, Cayouga, and the Tuscaroras came to Albany on behalf of the Six Nations as a whole. They told the commissioners that Governor Vaudreuil had sent a message to Jean Coeur (Louis-Thomas Chabert de Joncaire) in Seneca Country telling him that someone from New England had revealed Governor Burnet’s plan for a trading house at the mouth of the Onondaga River (Oswego). Governor Vaudreuil described his own plans to build a fort at Niagara and ships to sail Cadarachqui (Lake Ontario) as well as his intention to destroy the English house at Oswego.

The delegates said that the Six Nations reminded Jean Coeur that the French and the Haudenosaunee had recently fought a bitter war that ended with an agreement not to make war over frivolous things such as “Beavers and furrs.” If the French destroyed the English trading house and built the proposed ships and fort, it could mean war. They urged the French to live in peace with the English. They did not want blood shed in their country.

They begged their brother Corlaer (New York) to listen to this message too.  The French and the English should “live like friends together,”  neither becoming the first aggressor.  The delegates said they would take particular note of whether Corlaer followed this advice, in support of which the sachims had sent a large belt of wampum. They had sent a belt to the French with the same message. They wanted Governor Burnet to meet them at the beginning of June to renew the covenant and discuss important matters.

The commissioners responded that they were surprised that the Six Nations would allow the French to impose on them in such a way, at which point the page ends.  The remainder of their answer is missing.

Minute Book 3: 1725-February

From the only entry for February, which is another letter from the commissioners to Governor Burnet, it appears that Colonel John (Johannes) Schuyler continued to work with Massachusetts separately from the commissioners to negotiate with the forces in Canada that supported the Eastern Indians, or Abenaki, in the war known variously as Father Rale’s War, Dummer’s War and Greylock’s War. Massachusetts representatives William Dudley and Samuel Thaxter met Schuyler in Albany and left with him for Canada on February 6th. The commissioners told the governor that they had offered them support.

They also told the governor that they had a letter from Captain Harme Vedder, who was in the Seneca Country. He had informed them that Louis-Thomas Chabert de Joncaire, known to the Iroquois as Sononchiez and to the English as Jean Coeur, had spent the winter at Onnahec, the “little Seneca Castle,” with four men. In the spring they planned to go to Niagara. He told the Seneca that Vedder had orders to kill him, which Vedder denied, although he said that he would kill him if he deserved it.

Two Seneca sachems, Canakadrichha and Sagonadayane, met with the commissioners on May 11 and added to what they had heard in February from Sconondo about the relations between the Six Nations, the “far Indians” and New France. They confirmed that Onondaga leaders had met with the French governor (Philippe de Rigaud de Vaudreuil) and discussed their fears that western nations passing through the Six Nations on their way to Albany to trade might attack them. Governor Vaudreuil confirmed their fears and suggested that for their protection they should allow him to build two forts, one at “Jagara” (the present day Niagara River)

and one at the mouth of the Onondaga River where it enters Cadaraghqua Lake (Lake Ontario in the vicinity of present day Oswego, where the English were also planning to build a fort.) The governor gave the Onondagas wampum belts to convey his request to the rest of the Six Nations.

At a public meeting to consider whether to let New France build the proposed forts, the Six Nations decided to deny the request. They returned the belts to the French governor with a message that he should talk to Corlaer (the Iroquois name for the Governor of New York) and get “a proper answer” as to whether forts could be built at the proposed locations.  The Oneidas and Mohawks were not at the meeting, but later concurred in the decision. Nonetheless, the Seneca envoys had learned from reliable sources that Jean Coeur (Louis-Thomas Chabert de Joncaire, also known as Sononchiez) was planning to go to Niagara with 50 men to build the fort there. They also told the commissioners that the Seneca messengers sent to the far nations to invite them to come trade at Albany were expected back in a few days. They had conveyed the message, but did not know how many far nations would actually come to Albany. Messieur Tonty (Alphonse de Tonty, Baron de Paludy), the commander of the French fort at Le Detroit (Tuchsagrondie, the location of present day Detroit) had told them not to come. Canakadrichha and Sagonadayane asked the commissioners to send their own representatives to Seneca country to hear what the messengers had to say and to find out what Joncaire planned to do with his 50 men.

The commissioners thanked the Seneca sachems for refusing the French request to build forts. They said the forts were intended to prevent them from hunting and keep them poor so that eventually the French could “drive them into the sea.” They gave them gifts of blankets, clothing, and rum.

A few weeks later on May 29, messengers arrived from Kahnawake and Skawiennadie bringing seven hands of wampum to confirm what they had to say. They asked the commissioners to send messengers to the Six Nations to come to Albany to meet with representatives of their own nations and New England. New England had asked for the Albany meeting because Albany was the appointed place to meet about public affairs. The commissioners assured them that the path was open and that they were happy about the meeting. They informed them that “Some Gentlement from N England” were in town, probably sent for the purpose of talking to their sachems. They said that the New York Governor did not know about the meeting so they could not comply with the request to send their own messengers. However, it would be proper to let the New England representatives know about their message so that they could send for the Six Nations themselves. They offered to do what they could to bring the proposed treaty to a good conclusion.

As 1724 began, the struggle between England and France for trade and a military presence in the North American interior continued in full force even though technically they were at peace. Both imperial powers were pressuring the Six Nations and the many nations to the west, south, and north of them for exclusive trade agreements. English and French diplomats and military commanders came into conflict with each other as they attempted to get permission from the Six Nations and other native people to build trading centers and forts around the Great Lakes.

In the meantime, the war between New England and the Eastern Indians (primarily the Abenaki Confederacy) continued.

Laurence Claessen returned from a trip to the Six Nations (Haudenosaunee), where the commissioners had sent him in November 1723, and gave them an account of what had transpired. His first order of business was to ask the Seneca to take wampum belts to the “far nations” to the west of Iroquoia to encourage them not to listen to the French government in Canada.  The commissioners believed that the French were encouraging the far nations to join the Eastern Indians in their war against New England (Father Rale’s War), thus preventing them from trading with Albany.

The Six Nations met and considered this proposal for several days before telling Lawrence that they agreed that the French would do everything possible to prevent a direct trade between the far Indians and New York. The Six Nations feared that the Governor of Canada was planning to incite the far Indians to attack the Haudenosaunee, and for that reason the Seneca had stayed home. Finally three Seneca sachems agreed to take the commissioners’ belts to the far nations and added six belts of their own, explaining that they needed additional belts to cover all the different nations that needed to get the message.

The Seneca said they would come to Albany the following Spring with a large number of the far Indians and would meet Captain Jacob Verplank at the Lake, as the Governor of New York had requested. “The Lake” probably means Lake Ontario near Irondequoit Bay, where a contingent of Dutch traders had been living among the Seneca. They also explained that Jean Coeur (Louis Thomas Chabert de Joncaire) planned to build a fort and trading house at Irondequoit the following Spring with the Six Nations consent.

The commissioners conveyed this information to New York Governor Burnet in a letter. They added that they had retrieved a “negroe boy” from a “ffrench Indian” who had taken the boy from “Captain Hicks,” probably Captain Robert Hicks, a Virginia trader who commanded Fort Christianna, Governor Alexander Spotswood’s project to educate (and control) the Saponi and other indigenous nations.

On August 9th, delegates of the Six Nations stopped at Albany on their way to Boston for the upcoming peace conference to resolve the war between Massachusetts Bay and the Abenaki. Their speaker Odastichta told the commissioners that a new leader, Annatseineiin, or Annutseerie, had been appointed to replace Blue Back, who had recently passed away and who had cultivated good relations with the English. They also addressed the issue of forts and trading posts in their country, taking a diplomatic approach in explaining why the French had not removed the trading post at Niagara as New York Governor Burnet had requested. They explained that they had asked the French interpreter and diplomat to the Six Nations, Jean Coeur (Louis-Thomas Chabert de Joncaire) to remove it, but he said he would have to discuss it with the French governor. Odasticha said he thought that the kings of France and England would have informed the commissioners about this by now.

The Six Nations also announced that they were now entirely at peace with the Waganhas (Anishinaabeg), French allies who had nonetheless joined with the Six Nations in the Covenant Chain. Last but not least, they asked the commissioners to appoint three representatives to go with them to Boston.

The commissioners condoled the deaths of Blue Back and two other sachems who recently died. They agreed to tell the governor about the Six Nations attempts to remove the trading house at Niagara and Jean Coeur’s response, and said they were glad that the Waganhas had joined the Covenant Chain. Somewhat surprisingly, the commissioners declined to send representatives to Boston, explaining that the New York governor had not asked them to do so.

On the 20th of August the commissoners wrote to New York Governor Burnet, explaining what they had done to enforce the oath against trading with Canada and informed him that they had heard from Laurence Claessen that a party of Eastern Indians were going to attack New England, and also a rumor that Rutland had actually been attacked. They feared being attacked themselves, and asked for help in building stockades for the blockhouse at Mount Burnet.

They also informed the Governor that Massachusetts had communicated directly with Peter and John Schuyler about the upcoming peace negotiations, that John Schuyler had gone to Boston, and that Massachusetts would ask him to lead their forces [against the Abenaki]

The last entry for August is a request that the government reimburse the Reverend Thomas Barclay for the costs of educating Michell Montour, the son of Louis Couq dit Montour, a French and native trader who was killed by Chabert de Joncaire in 1709 after he began to work for the English recruiting “far Indians” to trade at Albany. The year before he was killed, Montour asked Barclay to care for Michell, who was five years old at the time.

The conference with Massachusetts Bay and the Six Nations (I will refer to them that way from now on, since the Tuscaroras were now established as a member of the Five Nations) continued on June 1st, when William Tailer, Spencer Phips, and John Stoddard renewed the Covenant Chain with the Schaghticoke, Katskill, and “River” Indians, a term used for the Mohican and the peoples of the lower Hudson.  Massachusetts Bay asked them to join the war if the the Six Nations accepted the Massachusetts Bay offer to fight the Eastern Indians. They replied that they would follow the Six Nations’ lead.

The Six Nations gave their answer on June 3rd. They soothed the feelings of the Massachusetts Bay representatives by rehearsing the wrongs inflicted on them by the Eastern Indians. But they explained that the Eastern Indians, had now sent a messenger to make peace. They needed to discuss matters further and it would take several months.

The representatives from Massachusetts Bay were clearly disappointed. They asked what the point of renewing the covenant was if the Six Nations would not help them fight their enemies, especially since they would be generously rewarded. They explained that they were not empowered to make peace with the Eastern Indians and asked once again for the Six Nations to join the war. Instead the Six Nations urged them to meet with the Eastern Indians at Boston in two months to discuss peace, promising to punish the Eastern Indians if an agreement was reached and they did not honor it. The Massachusetts Bay delegates finally agreed to attend the proposed meeting.

The Six Nations and the Albany Indian Commissioners went on to discuss their own issues, in particular the competing centers for French and English trade that were being constructed in Iroquoia. The French diplomat Louis-Thomas Chabert de Joncaire, referred to by the commissioners using every imaginable variant spelling of “Jean Coeur” had persuaded the Six Nations to allow the French to build a trading center at Kaskeghsago near Irondequoit, at the site of present day Rochester, where the Genesee River meets Lake Ontario. The commissioners asked the Six Nations to reverse this decision and forbid the French to build any settlements in Iroquoia, predicting that if  the French built a trading house at Irondequoit it would become a fort that would be used to stop “far Indians” from coming to Albany and eventually to take control of the Six Nations’ country. Furthermore, they asked the Six Nations to tell the French to remove their trading center already constructed at Niagara, as they had promised the New York governor previously. The Six Nations speaker, Thannintsorowee, said they would take the request back to their council and provide a response at the Boston meeting.

The Six Nations and the Albany commissioners held another meeting with the Abenaki envoy, lectured him about the violence inflicted on New England by the Abenaki, and told him that the Eastern Indians should come to the meeting in Boston scheduled in two months to negotiate.

The rest of June was devoted to trade. Another group of 10 far Indians came to trade on June 16th, asking for good prices and promising to bring more people if they received them. They were welcomed with provisions and rum, and assured that prices would be good. The name of their castle is left blank, suggesting that the commissioners were not familiar with it and unable to make sense of it. Magepanans, a River Indian, was asked to invite more nations to come to trade and promised a reward if he succeeded.

Governor Burnet had asked the Albany Indian Commissioners to enforce a recent act of the New York Assembly intended to stop the flourishing trade between Albany and Montreal. In this trade, which had been going on for decades, English goods were sold to the French and the French then resold those goods to indigenous fur traders. This practice undermined the English policy that aimed to monopolize the fur trade for England by persuading the indigenous fur traders to bring their goods directly to Albany.

Under the new act, Albany traders had to swear an oath that they were not trading with Canada, on penalty of a fine of a hundred pounds. The commissioners took the oath themselves and spent several days at the end of June in summoning local traders, many of whom were prominent citizens or relatives of the commissioners, and asking them to take the oath. Several refused and were fined, including Colonel John Schuyler and his son Philip Schuyler. The notes indicate that the money would be applied to repairing Albany’s fortifications or used as needed. On the 22nd, they wrote to the governor and reported on this, assuring him that they supported the policy, while acknowledging that goods were still being traded with the French. They also asked the governor to allow passage for three Frenchmen who were going to visit their uncle, a “famous trader” in Pennsylvania.
